Nah the rules clearly state that these territories are stacked to stop allies getting steam rolled, they serve that function.
They're like the territories around Berlin and Vienna, which also have the same function.

Also, do you need 3 straight victories or just best of 3, as I see on the map thread it is considered a stacked battle.

Or just remove stacked territories entirely, for both sides.
It's impossible for the attacker to win on them anyway.
